Defendant appeals her conviction for the second degree murder of her husband. A sharply divided Southern District of the Missouri Court of Appeals affirmed the judgment, but the cause was transferred to this Court on certification pursuant to Rule 83.01. We consider the matter as an original appeal. Mo. Const. art. V, § 10. The issues raised on appeal relate to certain evidence seized from the victim's house without a search warrant, denial of a continuance sought on the basis of pretrial publicity generated by the Hickley decision, and the trial court's refusal of defendant's mental state of mind instruction.
