Plaintiffs are licensed optometrists who also are dispensing opticians. Defendants are the members of the Wisconsin Board of Examiners in Optometry, a state administrative agency within the meaning of ch. 227 and ch. 153, Stats. On July 17, 1967, the secretary of the defendant board requested an opinion from the attorney general of Wisconsin as to the legality of certain advertising practices in the optometry field. The board was advised (56 Op. Atty. Gen. (1967), 201) that for optometrists who were also dispensing opticians to advertise their dual status constitutes unprofessional conduct under sec. 153.08 (1) and (2) and the board rule Opt 7.06.
